Risk Management & Process Safety Management Plans
The federal mandates of the chemical accident prevention initiatives of EPA's Risk Management Program (RMP) (40 CFR Part 68) and OSHA's Process Safety Management (PSM) program require facilities using certain quantities of listed toxic and flammable chemicals to have working plans in place at their facilities to reduce the possibility of an accidental chemical release. Because of their similar elements, ERL has assisted many facilities to prepare combined plans that address the requirements to protect their surrounding communities (RMP) as well as on-site staff (PSM).
Regulatory applicability assessment/Program Level determination is an essential first step.
Plan elements then include:
- Process Hazard Analysis
- Comprehensive Prevention Program [this section has 12 separate elements from Training to Hot Work Permits]
- Emergency Response Program
- Risk Management Plan
- Worst Case Release Scenario
- Alternative Release Scenario
- Five-Year Accident History
- Emergency Response Plan
Computer modeling to develop Offsite Consequence Analysis
Compliance audit checklist preparation
Training workshops for manufacturing facility managers
Regulatory required staff training sessions
Public information dissemination meetings
Accompanying compliance activities
Internal RMP compliance audits
General Duty compliance assistance
Note Although many facilities have chemicals which fall below the requirement thresholds according to RMP, they are required to maintain safe chemical handling procedures and practices at their facilities according to the General Duty Clause to minimize the potential for an accidental chemical release and to mitigate the impacts of any possible release.

Site Assessment and Investigation
Since 1985, ERL has completed environmental site assessments of over 3,500 properties ranging from undeveloped land to major chemical manufacturing complexes. We have provided assistance to attorneys and lenders during deals involving a single parcel and deals involving over 300 parcels across the United States. We have the experience to recommend the most effective approach to investigate the site and the technical expertise to evaluate the data and develop practical solutions for conditions of concern which are identified. We have participated in the assessment and evaluation of potential acquisitions of substantial property earmarked for major commercial development. Services available include:
Phase I Environmental Site Assessments (ESAs)
- ASTM E-1527 standard (new 2000 standard) Phase 1 ESA
- Lender-specific and customer-specific formats
